Purchases Made on the Queen Odelia Website

1.1.       These terms will be imposed on all purchases made via the website of products byQueen Odelia (B P Links Ltd.)515053015 (hereinafter: “B P Links Ltd”), 33Jabutinski Street, Ramat Gan, Israel, Postcode 5251107 , phone number +97235440118

1.2.       These terms will be imposed in addition to the general terms of use of the website.

1.3.       The initial term for execution of a transaction on the website requires the customer to be 18 (eighteen) years of age and over, or for a corporation to be incorporated as is pursuant to Israeli law. In addition, the buyer must be in legal possession of a valid credit card from one of the credit companies listed hereinafter: Visa, Mastercard, Paypal account (this list may be subjected to modification). The buyer must also be permitted pursuant to the law and/or pursuant to any agreement with the issuer of the credit card in the buyer’s possession to execute transactions by means of the aforementioned credit card.

Additionally, by making a purchase on the Queen Odelia website, the buyer are declaring by default that the buyer have an active Paypal account, and that the buyer are legally permitted to make such transactions with it. Also the buyerare declaring that the buyer have an active E-mail account.
In these Regulations the term “credit company” also includes Paypal.

1.4.       For the purpose of making a purchase on the website the buye rwill need to provide personal details, including credit card/details of the buyer’s Paypal account, E-mail address and other personal information, such as full address for delivery etc.

1.5.       The cost of the payment will be made in one payment. It will also be subjected to the terms of the credit company.

1.7.       After Queen Odelia receives the confirmation from the credit company for the purchase of the products the buyer selected,the buyer’s order will be processed, and the products the buyer purchased will be sent to the buyer, pursuant to the terms of these Regulations.

1.8.       If the buyer provide personal information such as the buyer’s address, identity number, credit card/Paypal account details etc, and/or if the buyer’s order is not approved by the credit company within seven days from the date Queen Odelia receives the refusal notice from the credit company, Queen Odelia will be permitted to cancel the buyer’s order, at its sole discretion.

1.9.       During the order process, the buyer will be granted access to the summary of the order details for review and confirmation. Once the buyer confirms the details of the transaction, there will be no modifications to add to the order.

1.10.   After completion of the purchase process, a confirmation E-mail will be sent to the buyer containing the details of the transaction.

1.11.   Purchasing Queen Odelia products on the website is for the buyer’s private/personal use only. It is prohibited to purchase products for commercial use.

1.12.   The execution of the purchase serves as a declaration that the credit card the buyer used to make the purchase is owned by the buyer or a corporation in the buyer’s name. The completion of the purchase also serves to declare that the credit card used in the transaction is valid and the buyer is authorized to use it, pursuant to law, and/or that the owner of the credit card is in agreement to execute the transaction for the sum of the relevant transaction and pursuant to its terms. If the purchase is via a Paypal account the buyer declares that it is the buyer’s account and that there is no preclusion pursuant to law for execution of the purchase via the account. In the event that the transaction is carried out by a corporation, the buyer declares that in addition to the aforementioned declaration, the buyer is authorized pursuant to law and pursuant to the incorporation documents of the corporation and resolutions authorized by the corporation, to execute the purchase.

2. Products

2.1.       The website serves the purpose of making sales of products marketed by Queen Odelia.

2.2.       The products displayed on the website are only part of the products sold by Queen Odelia (B P Links) from time to time. Queen Odelia is (B P Links) permitted to modify the products displayed on the website, to replace them, or to remove them from the website at any time, at its sole discretion, and without any notice.

2.3.       It is clarified that the photographs displayed on the website are designed solely for purposes of representation and illustration of the products sold on the sites.

2.4. Queen Odelia(B P Links) will do everything in it power to ensure that there is sufficient stock of the products on display, however be advised that product stocks change from time to time based on the products’ demand, manufacturing options, supply options, raw materials, and additional factors. In the event that a product is purchased which is not in stock despite its appearance on the website, Queen Odelia will be permitted to cancel the transaction for the product, and to send a notice to the buyer with the details of the transaction cancellation.

3. Prices

3.1.       The prices detailed on the website are in US Dollars.

3.2.       The prices of the products do not include delivery fees. The delivery fees are listed in full detail on website (Shipping terms section). The total delivery fee will appear in the summary of the order details and confirmation of the order that is sent to the buyer.

3.3.       The prices displayed on the website do not include any taxes and customs for overseas sales, and inasmuch as they will be imposed on the purchase, the fee will be imposed solely on the buyer.

3.4.       The prices of the products displayed on the website are correct as of the date stated on the prices page on the website.

3.5.       Queen Odelia (B P Links) reserves the right to change the prices of the products and/or the delivery fees, at its sole discretion, and without the need to provide any advance notice. Any changes as aforementioned will appear on the website and will be valid from the time that they appear on the website.

3a.     Coupons and/or discounts and/or promotions

Queen Odelia is permitted, but not obligated, to award the buyer with discount coupons and/or a discount and/or a promotion (hereinafter: “coupon”) at the time of purchase via the website/by direct electronic mailing.  Sometimes, a coupon will be offered at the time of purchase.

Ordering with coupon is subject to all the limitations that specified in the coupon and/or in the electronic mailing relating to it. The buyer will be able to use the coupon code once only for each purchase (unless if stated differently). It is emphasized that if the buyer does not claim the coupon and/or if the buyer does not enter the coupon code for any reason whatsoever, the buyer will not be entitled to receive a refund or compensation or any payment whatsoever.

4. Delivery

4.1.       Queen Odelia makes deliveries of its products to many countries however not to all the countries worldwide. During the purchase, the buyer will be required to enter the country to which the buyer requests the delivery of the products. If the buyer wishes to make an order to a country/area to which Queen Odelia does not make deliveries of its products, the buyer will not be able to complete the purchase process.

4.2.       As a rule, delivery of products take between 3-14 business days from the date of approval of the transaction by the credit company. There may be delays in the delivery, up to 30 days from the date of approval of the transaction. It will be clarified that Queen Odelia will not be responsible for any delay of delivery including  force majeure, war, strike, a terrorism act, disruptions or malfunctions.

4.3.       The delivery will be sent to the address that the buyer registered in the order details on the website, in condition that this is a country/area to which Queen Odelia carries out deliveries and that it is not a post office box number.

4.4.       Be advised that if at the time of the website purchase the buyer provides invalid personal information, and/or an address which is a post office box, Queen Odelia will not be able to deliver the requested items, and the buyer will be charged with payment for the delivery and handling fees, as detailed on the website.

4.5.       If the products do not reach the buyer by 30 days from the date of purchase, the buyer will be able to cancel the transaction and receive a refund money in full.

5. Cancellation of a transaction

5.1.       Pursuant to law, the buyer is entitled to cancel the transaction within 14 days from the time of its approval or from the time of receipt of the product. In such a case, the cancellation fee goes at a 5% rate that will be deducted from the credit refund. However, no more than 30$ USDollars will be deducted, as pursuant to Israeli law. The payment that Queen Odelia will be charged by the credit company for the cancellation will also be deducted from the credit refund.

5.2.       The buyer will be entitled to cancel a transaction within 14 days from the order approval or from receipt of the product in cases of defected products, delivery of products that were not ordered, in the case an order did not reach the buyer, or in case one of the products ordered is out of stock, 30 days from the date of the order approval. In such a case the buyer will be receive a complete refund for the entire sum that the buyer paid to Queen Odelia or given a replacement product.

5.3.       In the event that the buyer wishes to cancel a transaction, the buyer will be required to send a notice in writing within the time periods detailed above, to Queen Odelia’s Customer Service Department by E-mail to the address:[email protected] . Following the buyer’s notice of cancellation, the buyer will receive a form in an E-mail on which the buyer will be requested to fill in the appropriate details regarding the cancellation.

5.4.       The buyer is required to return the product as it was receives, in its original packaging, and on condition that no use has been made of it.

5.5.       After receipt of the product by B P Links credit will be made pursuant to the credit company’s procedures.

6. Cases in which it is not possible to receive a refund

It is impossible to split the return of products purchased in a combined transactions of “Buy Receive” or “1+1” promotions. The buyer may not cancel and return parts of the items included in the transaction. The buyer may choose one of the following options: a) to cancel the combined transaction and return everything that was purchased, b) not to cancel the combined transaction.

7. Guarantee for the products

The guarantee for the products that the buyer purchases on the website is subject to the provisions of the Consumer Protection Law, 5741-1981 imposed in Israel and pursuant to the terms of these Regulations.

8. Limit of guarantee

8.1.       Queen Odelia and/or any entity affiliated with Queen Odelia, their employees and/or their representatives are not liable in any way whatsoever for any damage and/or loss and/or expense caused to the buyer and/or anyone purchasing products on the buyer’s behalf and/or in the buyer’s stead, whether directly or indirectly, in regard to and/or derived from the buyer’s use of the website. Furthermore, Queen Odelia and/or its representatives are not and will not be liable in any way whatsoever for any request which cannot be executed.

8.2.       Queen Odelia will not bear any liability, whether directly or indirectly, for any reason whatsoever, in an event in which the buyer is not able to make use of the website, whether partially or fully, and execute transactions via the website.

8.3.       In the event of a scribal error, an error in description of a product and/or its price, the payment terms, a photograph of the product and/or any other information detailed on the website, an error in the buyer’s details as they will appear in Queen Odelia’s databases, and any other error, Queen Odelia will be permitted, but not obligated to cancel the transaction in full or in part and refund to the buyer any payment that the buyer paid.

8.4.       Queen Odelia will be permitted, at its sole discretion, to transfer the ownership of this website to a third party, this on condition that the buyer’s rights pursuant to these Regulations will continue to be applicable. The buyer agrees that Queen Odelia will be permitted to transfer the buyer’s details, in its possession, to a third party in the event of transfer of ownership as aforementioned.

9. Law and jurisdiction
   The laws of the State of Israel will only be imposed on the use of the website. The sole jurisdiction for any issue and matter derived from this website is solely and only the authorized court in the district of Tel Aviv-Jaffa, Israel.

10. General

10.1.   Queen Odelia will be entitled to cancel any purchase transaction/order at any time if it the buyer breaches any of the provisions of these Regulations/general terms of use or the provisions of any law.

10.2.   Queen Odelia has the sole discretion to make changes to these Regulations. The change, inasmuch as there will be such, will be imposed from the date of its publication on the website. The buyer’s use of the website after the change constitutes the buyer’s consent to the change therefore we recommend that the buyer to reread the provisions of the Regulations from time to time.

10.3.   Non-use of any right awarded to Queen Odelia pursuant to these Regulations will not constitute a waiver of that same right in that incident and/or other incident, similar or dissimilar.

10.4.   In any event of a claim, in any shape or form, in all matters related to, entailed in or derived from this website the date of filing the claim will be restricted up to one year from the date of creation of the cause and over and above this date obsolescence will be imposed on the claim. Also, the maximum compensation to which the buyer will be entitled, if at all, will be limited and this will only be after the buyer proves the buyer’s claim for any cause whatsoever up to 100 Euros and no more than this and this without harming the buyer’s right to receive return of any payment that the buyer have made to Danya if the authorized court will rule that the buyer are entitled such.

10.6.   Be advised that if any provision in these terms is illegal or will become illegal, is invalid or cannot be enforced, the rest of the provisions will remain in force.

10.7.   In these Regulations the female gender is alike the male gender and vice versa. The singular is alike the plural and vice versa.
